    I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

    Hi,

    If the labor from BEC gets approved and subsequent I140 as well, is it possible to request only the priority date change for the I485?

    Not refering to replace the I140. IS IT POSSIBLE TO JUST REQUEST THE PRIORITY DATE?

    Hi,

    I have my L1 Visa from X Company and I traveled to US for 2 months.
    I also have my H1B Visa from Y Company stamped in my passport.

    I am planning to enter US with my L1 Visa and then change my status to H1B after a month.

    1) If I get a job, can I change my status from L1 to H1 within a month? Is there any minimum period to work on L1 for change of status?
    2) Do I need the consent of my X Company for having the change of status to H1B done?
    3) What documents are required for the change of status? I will not have my pay stubs during my stay on L1 status, as I will be paid just the per diam.
    4) If I enter US with my H1B Visa and if I am deported to my Home country (because I just have 7 months) validity of my H1B (or) due to employer-employee relationship issue), can I still use my L1 Visa of my X Company to revisit US?

    Please advise.

    Hi I just graduated last year as an accounting major. I recently got an offer for a Property Accountant position at a real estate company. So it's not a pulic accounting firm. I was wondering if I'm eligiable to apply for H1B without a CPA?

    My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
    It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
    I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
    They say they can refile again .. but duno what to do ??
    Can anybody be kind enough to help me out here!
    I am so frustrated that I feel like going back to home country now.

    No he doesn't have pending GC status.His wife is on 4th year of H1 and she already got EAD.But her priority date is not current (Sept 06)to add him to her GC status immediately.

    This looks similar to the PERM applied for labor... It would be faster for new applicants.. but old applicants could get stuck again... for years... and years... not due to visa.. but due to transformation...

    Hi
    With the current market crisis, you never know when you will be out of job.
    Though I have my H1B valid till 2011( my I140 is approved and is already over more than six months, 485 is pending), Most of the people suggesting me to apply for EAD.

    1) What are the procedures I have to maintain ( in connection to USCIS and my green card application pending) if I change employer?

    2)Can I also work for multiple employers on EAD?
