    I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question

    I'm applying for:
    a) Permission to accept employment
    b) Replacement
    c) Renewal of my permission to accept employment

    I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response

    Please advise.....

    I would like to get your opinion on current situation.

    Education: MS(Ind Engg), 5+ yrs exp.

    I have priority date of Oct -2007(applied for labor under EB3). Got approved I-140 in Feb 2008( EB3 category). I got promoted to next level so requested to apply for labor once again in EB2 category in Feb 2009 and got approved labor in Feb 2010.

    Is there a provision to amend labor and include previously approved I-140? Or Do I have to apply I-140 once again? and my priority date would be Feb 2009?

    Anyone has been in the similar situation. I really don;t want to start my PERM application if owning a company stock will trigger an audit.

    If there is even a slight possibility, I would like to give back the stocks to the company (if it is possible)

    Hi Guys,
    I was reading another thread and a question came to my mind..

    I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.

    Can anyone can shed some light on this situation?

    I am in the same situation. I thought that I will get new I-94 but not. My lawyer says that keep EAD and Dr. Lic with me all time in case I need to prove that I am legal ....

    Hello --
    Do any of you know what the A# is on the I-485 / I-130 / I-765 etc is for people who have previously held an F-1 / OPT-related A#? I have seen previous forums stating that OPT A#s begin with a "1" which connotes an OPT status; however I am not clear whether we are supposed to use that same A# on our I-485 and other GC-related documents, or leave that space blank.

    Sorry this is redundant but previous posts don't seem to clarify a definitive answer to this question. Many thanks in advance.

    Here is my situation:

    I was joined as a contractor at CLIENT through client's preferred VENDOR. My paystub runs by my EMPLOYER. I use to submit my timesheets to my EMPLOYER and VENDOR every week. My EMPLOYER runs my paystub everymonth with minimum pay amount and not as per actual earnings. For ex:my actuals were $9500/- per month, he rans for only $6000/- every month. This gap is because he says he didn't receive the payments from VENDOR. With these gaps everymonth the dues between my employer and me has increased a lot, and my employer has to pay to me some $xx thousands dollars. There is no document/written evidence with me from my employer. My employer always tells me on phone, how much they paid to me and how much of mine they are holding.

    After my contract completion(for ex:10/30/09) at CLIENT, I joined and started as a Full Time Salaried employee at CLIENT on 11/5/2009. I submitted my resignation to my previous EMPLOYER on 11/16/2009.

    I have to collect my dues(ex: $xx thousands) from previous EMPLOYER. How can I proceed further to collect these dues, as there is no document / written evidence with me from him. My previous employer always communicate with me on phone to update the money transactions.

    My current visa status is, I am a Green Card holder.

    Please help me how to proceed in collecting my dues from my previous employer.

    My take and I am far from a lawyer.. so this is not legal advice...

    You can study on H4
    You cannot accept a scholarship
    You cannot take an in-campus job
    You cannot do an internship, apply for CPT or OPT's
    If the above are all true.. there is no need to inform USCIS

    You are eligible for 3 years extension with the approved I140. I also applied my H1 extension by attaching approved 140 for 3 years extension, I got it last month...

    it will not like 2 yrs and then 3 yrs.....go for 3 years...I think lawyer should know all these....

    I want to keep this thread on top for a while to see how many People with priority date between Jan'05 and March 28th '05(Filed under RIR/NON-RIR) applied again in PERM. The reason is lot of Friends i know applied their labor again in PERM since the Old Labors filed under RIR were sent to BEC Center's in Phily and Dallas for 'cold storage' and forgot to port the dates after the old labor approval since the time regained was not big enough.

    This gives us an fairly good idea to see how quickly the dates would move from Jan' 22nd '05 as many fear there might a huge figure here who applied between December '04 and March 28th '05 under the old process and before PERM kicked in .

    Please do not forget to mention if you have ported the dates from your old labor.

    As far as I know once you use 6 years of H1 you can only regain it is by leaving US for 1 full year and can re-enter on a new H1.

    True, i did not use EAD but i went to India and came back using Advance Parole. My Lawyer says i need to switch back to H1 by filing the change of status again(fee $1300).

    I have H1 till 2010 but not stamped in my passport.

    For your condition, I believe for #15 is AOS pending .. you will lose your H1/H4 status when you entered using AP.

    not sure about #14, I think it's PAROLEE.

    I looked at different forums. But I could not locate a definite answer for my questions.

    I have H1. My wife has H4. Both will expire in 11/2009. I don't have stamp
    but she has stamp. We both used AP to enter into USA recently. We did not use our EAD.

    Questions on EAD paper filing :

    14) Manner of Last Entry into the U.S. ?
    15) Current Immigration status ?

    I believe that the answer to the question 14 should be PAROLEE or Advance Porole. How about question 15 ?

    The immigration officer put 'Conditions: AOS DA' in our AP and new I-94 both. What will be the answer, AOS Pending or H1B/H4 ?

    Please share your experience. Thanks in advance.
